The devil is in the detail I haven't even looked at anything on them, I bet that puts me in the "click the I accept the terms and conditionswithout reading them" majority. What is the devil that is in the detail? Well…… Call me a cynic, but I’ve spent a career in property, so I am conditioned to look for issues in leases. An occupational lease for an entity like a semi professional football club with ambitions to grow and become a full time operation playing in the EFL will need a term sufficient to give long term security. That doesn’t just mean the right to be in occupation, but also rights to enable the club to invest in the ground as it rises through the leagues to improve the standard of the stadium. That in my experience requires a term of more than 40 years, if only because a term of that length will not provide sufficient asset value to secure a bank loan. Now maybe the plan is to use shareholder capital and not debt to do that, which is fine, but even then, those providing the capital will want to know what they are getting for their money. The lease also ought to allow the club to exploit any development potential (as the old lease did) which puts money into the club and not the pocket of a nefarious owner. Again, experience tells me a 40 year lease wouldn’t usually allow this. For all that, I am delighted the club has secured a better lease than it had and can make plans. Leases are simply contracts between parties and it is perfectly possible for terms to be varied and renegotiated as circumstances change. The Council as freeholder has demonstrated it wants to support the club’s developmemt and evolution by granting this lease and the club were being advised by someone who was appropriately qualified, so the details ought to be OK.
